What Information We Collect
The information we learn from customers helps us personalize and continually improve your experience with our products and services. Here are the types of Personal Information we gather.
Our servers automatically collect certain non-personally identifiable information, such as your computer’s IP address, the type of browser you use, the pages you view, the streams you view or listen to, and when you visit our Site. We use this information to understand how visitors navigate through our Site and use our products and services. This allows us to enhance your experience while using our Site and to make the materials we post as valuable to visitors as possible. We do not link this information to Personal information.
Information You Give Us
Generally, you may browse the Site without providing any Personal Information. You may, however, voluntarily provide Personal Information to us in other ways, such as through registration for contests and sweepstakes, awards points, loyal listener clubs, chat rooms and message boards. You can choose not to provide certain Personal Information, but then you might not be able to take advantage of many of our features. We use the Personal Information that you provide for such purposes as responding to your requests, customizing your experience, improving our product, and communication with you. When you create an account providing your name, email address, zip code and birth date and choose a password and password hint (such as the month and day of your birth) for security, the system saves your information and assigns you a personal ID often comprised simply of your email address because it is unique and easy to remember. Some of this information may, on occasion, be transferred to operational service providers to automatically fill in relevant form fields and simplify the form. This information is not stored on the third party website until you submit the form. However, once the form is submitted, this Personal Information may be stored on the third party website.
Off-Line Collection, Use, And Disclosure of Personal Information
The Station also collects and uses Personal Information by other means, including telephone, direct mail and in person. The various uses of such Personal Information include, but are not limited to, contests and sweepstakes, loyal listener club registration, other special membership only features/events, news tip line, job applications, listener complaints, and operational and business purposes.
Except for contests and sweepstakes entries, or registrations for a loyal listener or other special membership features/events, we do not ordinarily use your Personal Information collected off-line for promotional or advertising purposes, nor do we share it with third parties for promotional or marketing purposes. If Personal Information collected off-line will be used by the Station, its parent company(s), or Affiliates for promotional and marketing purposes, you have the opportunity to Opt-out of such use. If such information will be shared with advertisers, you will have the same rights as provided for the disclosure of Personal Information collected online.
Why and How We Use the Information Collected
Good Karma collects information to assist us in delivering our product and service and gain a better understanding of our customers, their needs and the types of content most popular with users. This allows us to determine how best to provide useful information to our users and to understand the services and parts of our Site that are of most interest to them. In addition, your Personal Information allows us to keep you posted on the latest product announcements, updates, special offers, promotions and events that you might like to hear about. The information is also used to improve our software and services by providing personalized content, recommendations, location customization, and/or personalized help and instructions. We also track the content you access and download, where appropriate, for purposes of paying royalties and license fees to third party providers such as record labels, other copyright holders, content distributors and advertisers.
Technologies Used to Collect Information
In addition, our advertisers will often employ “click through” advertisements on the Site, which link to content on their websites. When a customer clicks through one of these advertisements, they are directed away from our Site to the advertiser’s destination page through a web server. Advertisers track this click-through data to determine general interest and measure the effectiveness of their advertising.
We do not generally keep e-mail correspondence, except e-mails related to the on-air programs or operations of the Station. As required by the Federal Communications Commission (“FCC”), if any part of your email correspondence relates to station programming or operations, we must place such correspondence in the Station’s FCC Public Inspection File, or make the correspondence available via electronic file access at the Station to anyone that requests such information. Therefore, please be advised that Personal Information contained in emails related to Station programming and operations will be disclosed to the general public. We therefore request that you not place any Personal Information in email correspondence to the Station that pertains to station programming or operations. Further, you understand and agree that we are not responsible for the disclosure of your Personal Information that is included in such emails that are made available to the general public in compliance with FCC regulations.
Shopping & E-Commerce
In connection with the sale of goods and/or services or for contest prize fulfillment, we may request Sensitive Personal information. “Sensitive Personal Information” includes any individual’s (1) social security number; (2) driver’s license number or state identification card number; (3) employee identification number; and (4) credit or debit card number, with or without any required security code or personal identification number (“PIN”). Sensitive Personal Information will only be used for verification of your identity, federal or state tax reporting requirements, and/or to implement and complete the specific activity or event it was submitted for. We will not share your Sensitive Personal information for marketing or promotional purposes. The Site may also request additional Personal Information such as your name, billing and shipping address, email address and/or telephone number and any such information that is required to fulfill your order and to communicate with you regarding your order. Sensitive Personal Information will be encrypted or collected through a secured Internet connection generally via SSL or S-HTTP protocols. Sensitive Personal Information will be stored in a commercially reasonable secure manner. We may use your Personal Information (but not your credit card or debit card number or other Sensitive Personal Information) to contact you about future products, services and discounts from the Station or to provide such information indirectly from our advertisers unless you tell us otherwise (i.e., “opt-out”). We will only use your credit card and debit card number to complete the specific transaction you requested. Alternatively, the Site may use a third party operational service provider to conduct the financial transaction in a secure manner; the third party payment process will be accessible via a hyperlink from the Site and the operational service provider will be solely responsible for all financial transactions and the collection, use and storage of your personal information.
Chat Rooms, Message Boards and Public Areas
For your enjoyment and entertainment, this Site may offer user interactive activities such as blogs, chat rooms, message boards, and/or public forums (“Public Areas.”) If you are required to register to use any interactive area, we do not share any Personal information or Sensitive Personal Information that is entered into the Public Area registration section on the Site with advertisers. However, any such information that is posted in the Public Area is available to anyone using the Site.
Although persons of all ages may visit our Site and participate in activities that do not require the collection of Personal Information, we do not knowingly or intentionally collect Personal Information from children under the age of 13. Except for the limited circumstances listed below, we will automatically reject and delete the registration or entry of any person we believe in good faith to be under age, and disqualify such person from the receipt of any prize, benefit or participation to which they may have otherwise been entitled by virtue of such registration or entry. Except to meet FCC regulations, as required by applicable laws, or other regulatory and legal purposes, we will not use, store or disclose any child’s Personal Information to a third party without prior parental consent.
When We Disclose Information
The Station does not use your Personal Information for purposes inconsistent with those listed above. Furthermore, the Station does not sell, rent or share your Personal information to or with any third party without your consent, except as discussed below.
Additionally, the Station may be required to provide aggregated access and usage information to certain content providers and rights holders as a condition of content licensing and royalty requirements. In such cases, the Station may provide usage access, demographic and other information, not including your Personal Information, to the content provider and/or rights holder.
We will also share your personal information with our operational service providers, the specialists that provide internal support to the Site design, development, hosting and operations, including maintenance, management, storage and/or fulfillment of our membership and e-mail clubs, various contests, sweepstakes, services, events and online stores. We use operational service providers to efficiently provide the full range of content, activities and membership services we bring to you. These operational service providers are bound by strict contractual requirements to keep all Personal Information they process strictly confidential and to use such information solely on behalf of the Station and Good Karma.
The Station may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on the Station; (b) protect and defend the rights or property of the Station or Good Karma and its products; or (c) act in urgent circumstances to protect the personal safety of users of the Station’s products and/or services or the public at large.

Security of Personal Information
The security and confidentiality of your information is extremely important to us. We have implemented technical, administrative and physical security measures using acceptable industry standards of security technology and practices (such as electronic security systems and password protections) to try to protect Personal Information from unauthorized access and improper use. Our databases are accessible only by authorized personnel. We also request that our operational service providers take such precautions. From time to time, we review our security procedures in order to consider appropriate new technology and methods.
As of January 1, 2005, California Civil Code Section 1798.83 permits our customers who are California residents to request certain information about how to exercise our third party disclosure choices. Changes to this Policy
Review, Update or Deletion of Personal Information
You may review, update or delete your personal information collected by the Site. To do so, please e-mail the Site’s Privacy administrator at PRIVACYADMINISTRATOR@gkbradio.com. To have access to your personal information, you must provide proof of identification, such as your full name, street address, city/state and zip code, user ID and password, and/or information about your recent activity on the Site. We reserve the right to deny access to any user if we believe there is a question about your identity. Certain types of Personal Information that are necessary to check eligibility, such as birth date or age, cannot be modified or deleted.
